General Data Protection Regulation Compliance
Right to access
Part of the expanded rights of data subjects outlined by the GDPR is the right for data subjects to obtain from the data controller confirmation as to whether or not personal data concerning them is being processed, where and for what purpose. Further, the controller shall provide a copy of the personal data, free of charge, in an electronic format. This change is a dramatic shift to data transparency and empowerment of data subjects.
Right to be forgotten
Also known as Data Erasure, the right to be forgotten entitles the data subject to have the data controller erase his/her personal data, cease further dissemination of the data, and potentially have third parties halt processing of the data. The conditions for erasure, as outlined in article 17, include the data no longer being relevant to original purposes for processing, or a data subjects withdrawing consent. It should also be noted that this right requires controllers to compare the subjects’ rights to “the public interest in the availability of the data” when considering such requests.
GDPR introduces data portability – the right for a data subject to receive the personal data concerning them, which they have previously provided in a ‘commonly use and machine readable format‘ and have the right to transmit that data to another controller.
Privacy by design
Privacy by design as a concept has existed for years now, but it is only just becoming part of a legal requirement with the GDPR. At it’s core, privacy by design calls for the inclusion of data protection from the onset of the designing of systems, rather than an addition. More specifically – ‘The controller shall..implement appropriate technical and organisational measures..in an effective way.. in order to meet the requirements of this Regulation and protect the rights of data subjects’. Article 23 calls for controllers to hold and process only the data absolutely necessary for the completion of its duties (data minimisation), as well as limiting the access to personal data to those needing to act out the processing.
Site Terms & Conditions
The property is mine to advertise or I have the express permission of the owner
Sub-letting is not permitted within many tenancies/leaseholds. If you are found to be sub-letting this can be cited as breach of contract thus leading to the contract being terminated and you being evicted. It is imperative that you are legally entitled to enter into a contract before going ahead. When joining our site you are bound by these T&Cs and must act accordingly. It is not our position to investigate who owns the land. It is up to you to be truthful when offering property (property covers any premises/land offered on our site).
If you stay longer than the allotted time your payment method shall be billed for either the next hour or the number of hours that you overstay. If you attempt to nullify the payment a dispute shall be opened with your bank/credit card provider. If you have purchased one of our products online and not cancelled within the allowed time; no fewer than 60 minutes before the booking. If you have paid by cash and refuse to pay the time exceeded then we reserve the right to take legal action. Please see ‘Law on the Web‘ for a definitive guide to the actions available to us. If you are a commercial customer then we exercise the right to take action according to the Late Payment of Commercial Debts (Interest) Act 1998 as stated on GOV.UK.
Any booking can be cancelled with a full refund as long as it is cancelled more than 24 hours before the booking is to take place. You will be refunded 7 days after the cancellation. This is due to Stripe’s payment schedule. If you cancel with less than 24 hours notice, no refund shall be given as the listing may not have enough time to take further bookings for that period.
To qualify for the subsidy you must list your property as available to book for 15 days per calendar month for a minimum of 6 hours per day or until Rent My Drive Ltd has received commission of £180.00. This gives us the chance to recover the fee that we have to pay the installer. Once the fee of £180.00 has been recovered you can then list your property as available or unavailable for whatever period you so desire. If you cancel your listing within 12 months from the date of installation you will have to settle the installation cost of £180.00 unless it has been recovered through booking fees. This means that Rent My Drive Ltd has received commission of £180 or greater.
